1. Acceptance of Terms
By accessing the website xamxamgraph.com (the "Site") and using the services of XamXam Graph ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use the Site or our services.
2. Description of Services
XamXam Graph provides data architecture consulting, data pipeline engineering, data governance, and agentic AI automation services. Our services are provided on the basis of commercial proposals and individualized service contracts. The Site presents our offerings and enables contact.
3. Intellectual Property
All content on the Site (text, images, graphics, logo, brand, source code) is the exclusive property of XamXam Graph and protected by Senegalese, Québec, and international intellectual property laws. Any unauthorized reproduction, distribution, or use is prohibited without our prior written consent. Open source code published on our GitHub repositories remains governed by its specific license (MIT).
4. Client Obligations
In the context of our consulting engagements, the client undertakes to: provide reasonable access to systems, data, and personnel necessary for the execution of the engagement; respect the confidentiality clauses agreed upon contractually; make payments according to the deadlines defined in the commercial proposal.
5. Limitation of Liability
XamXam Graph undertakes to provide its services with diligence and professional competence. Our liability is limited to the amount of fees received for the relevant service. We cannot be held liable for indirect losses, loss of profits, or damages resulting from inappropriate use of our deliverables. Analytical results provided are for informational purposes and do not constitute legal or financial advice.
6. Governing Law
These Terms of Service are governed by Senegalese law for clients based in West Africa, and by Québec law for clients based in Canada. Any dispute relating to the interpretation or execution of these terms shall be submitted to the competent courts of Dakar (Senegal) or Montréal (Québec), depending on the applicable jurisdiction.
7. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Modifications take effect upon their publication on the Site. Continued use of the Site after modification constitutes acceptance of the new terms.
